Today’s litigious society puts many professionals and business owners at risk of unwarranted litigation. As a result, it has become a necessity for professionals to implement a plan to protect their assets, which in turn, helps protect their reputation, time and peace of mind.

Our practice, since 1978, has involved business reorganization and creditors rights. An outgrowth of this practice, representing creditors trying to collect money and borrowers seeking relief from creditors, has been advising clients, some having lost substantial assets who have come back or are about to come back financially. These clients’ entrepreneurs, professionals (medical and law) , other highly compensated persons who have accumulated substantial assets, are asking for advice as to how to not find themselves in that circumstance again. The question is how to protect themselves and their assets, when and if, the unlikely will happen again.

Our experience with clients in reorganizations and workouts who have come back from the edge and do not want to risk there assets again has given us invaluable insight into what clients needs are and how to protect them.
We also implement an “asset freeze” by shifting valuable assets to other family members or entities (in trust or otherwise) at a time when the client has no existing or foreseeable claims. Combinations of corporations, trusts, limited partnerships and other legally recognized vehicles, in conjunction with asset classes exempt from creditors by statute, are used to prevent our clients from being attractive targets.
